1. Overview
This policy describes the ownership and permitted use of PSW Pro content, software, branding, and Customer Data. It forms part of our Terms of Service.
2. PSW Pro Branding
The PSW Pro name, logo, and related branding are owned by or licensed to PSW Pro. These trademarks may not be used without prior written permission, except as necessary to identify PSW Pro when referring to the platform in good faith.
3. Software and Interface Ownership
PSW Pro and its licensors retain all rights, title, and interest in and to the platform software, source code, interface design, databases and database structures, features, workflows, and derivative works. Except for the limited licence granted under the Terms of Service, no rights are granted to you by implication, estoppel, or otherwise.
4. Website and Blog Content
Original content published on the PSW Pro website, including articles, guides, graphics, text, and documentation, is owned by or licensed to PSW Pro. You may view and use this content for personal, non-commercial, or internal business informational purposes. You may not copy, modify, distribute, sell, or commercially exploit website or blog content without prior written permission.
5. Templates and Forms
PSW Pro may provide sample forms, policies, templates, checklists, or other documents as part of the platform. These are provided for general informational and administrative purposes. You may adapt and use templates within your own business or practice, but you may not resell, redistribute, or commercially exploit the original template content without permission.
6. Permitted Use
Subject to the Terms of Service and payment of applicable fees, PSW Pro grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable licence to access and use the platform for your lawful internal business or professional purposes.
You may not use the platform outside the scope permitted by the Terms of Service or any applicable written agreement.
7. Customer Ownership of Customer Data
As between you and PSW Pro, you retain ownership of your Customer Data. Customer Data means information, records, documents, files, and other content submitted to the platform by you or your authorized users.
PSW Pro does not claim ownership of your Customer Data. You grant PSW Pro and its authorized service providers a limited licence to process Customer Data only as reasonably necessary to provide, maintain, and secure the Services.
8. User-Submitted Content
If you submit feedback, suggestions, ideas, or other content to PSW Pro outside of Customer Data (for example, feature requests or support communications), you grant PSW Pro a worldwide, perpetual, irrevocable, royalty-free licence to use, modify, incorporate, and commercialize that feedback without restriction or compensation.
This does not give us ownership of your Customer Data or personal information.
9. Third-Party Trademarks
Third-party names, trademarks, service marks, and content that may appear on or through PSW Pro remain the property of their respective owners. PSW Pro does not claim any rights in third-party trademarks.
10. Copyright Complaint Procedure
If you believe that content on PSW Pro infringes your copyright or intellectual property rights, please notify us promptly. To help us investigate, include the following information in your complaint:
- Your name, organization, and contact information;
- Identification of the copyrighted work or intellectual property you believe has been infringed;
- Identification of the specific content on PSW Pro that you believe is infringing, including the URL or location;
- A statement that you have a good-faith belief that the use is not authorized;
- A statement, under penalty of perjury, that the information in your complaint is accurate and that you are the owner or authorized to act on behalf of the owner;
- Your physical or electronic signature.
Email complaints to support@pswpro.ca with the subject line "Copyright Complaint."
11. Counter-Notice and Response
If your content is removed based on a copyright complaint and you believe the removal was in error, you may submit a counter-notice. Include the reasons you believe the content should not have been removed and your contact information.
PSW Pro will review counter-notices in good faith and may restore content if appropriate.
12. Repeat Infringement
PSW Pro may restrict or terminate access for users who repeatedly infringe the intellectual property rights of others.
13. Good-Faith Reporting
PSW Pro expects copyright complaints to be submitted in good faith. Knowingly submitting false or misleading complaints may result in liability for the complainant.
